The Authors provide their annual update on the issues being used by litigants opposed to oil and gas operations. The most significant issue now being used with some limited success in attacking hydro-fracing projects is seismic tort claims. The authors provide an overview of the most recent research related to seismic activity in Oklahoma and Texas and Alberta, actions taken by regulators to help the industry address seismic uncertainty by transforming it into a permitting issue, and recommendations on how to refute and address the issues based on recent court decisions.
